The actual delivered product may differ from illustrations shown — including but not limited to: enclosure geometry, colour finish, component layout, PCB revision, display model, connector placement, and any other aesthetic or minor functional attribute — as a result of ongoing engineering refinements, component availability, manufacturing improvements, or version updates made without prior notice.

Pre-Production Units

Products listed as "Pre-Order" or "Priority Batch" are in active development. Specifications, features, form factor, and pricing are subject to change. Helmet.Theory reserves the right to alter the final product in any manner it deems necessary to improve safety, reliability, performance, or manufacturability. Customers will be notified of material changes via the contact information provided at time of order.

No Guarantee of Exact Match

By placing an order or joining a waitlist, you acknowledge and accept that the delivered unit may not match promotional images exactly and that this does not constitute grounds for a refund, chargeback, or dispute — unless the product materially fails to perform its core stated function.

Terms of Service

Acceptance

By accessing or using the Helmet.Theory website and all associated subdomains, placing an order, joining a waitlist, or submitting any personal information, you agree to be bound by these Terms of Service. If you do not agree, do not use this website or place any order.

Eligibility

You must be at least 18 years of age to place an order. By placing an order you represent that you are of legal age in your jurisdiction. Helmet.Theory products are intended for use by persons knowledgeable about motorcycle electronics and are not designed for use by untrained individuals.

Product Use & Safety

Helmet.Theory products are aftermarket accessories designed to be installed by competent individuals with appropriate technical knowledge. You are solely responsible for ensuring correct and safe installation. Improper installation, modification, or misuse of any Helmet.Theory product that results in damage to your vehicle, personal injury, or third-party harm is entirely the buyer's liability. Helmet.Theory bears no responsibility for any loss, damage, or injury resulting from incorrect installation or use.

Pricing & Availability

All prices are displayed in the applicable currency and are subject to change at any time without notice. Helmet.Theory reserves the right to cancel any order due to pricing errors, stock unavailability, or fraud suspicion, with a full refund issued in such cases.

Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.

Limitation of Liability

To the maximum extent permitted by applicable law, Helmet.Theory, its creator, affiliates, and partners shall not be liable for any indirect, incidental, consequential, special, or punitive damages — including loss of profits, data, goodwill, or vehicle damage — arising out of or related to your use of our products or services. Our total cumulative liability to you shall not exceed the actual purchase price you paid for the specific product giving rise to the claim.

RETURNS & REFUNDS

Returns & Refund Policy

Pre-Order / Waitlist Cancellations

Pre-orders or waitlist deposits may be cancelled and fully refunded within 14 days of the payment date, provided the order has not yet entered production or shipping. After this window, cancellations are at Helmet.Theory's sole discretion.

Defective or DOA Units

If you receive a unit that is dead on arrival (DOA) or exhibits a manufacturing defect, you must contact us within 7 days of delivery with video and photographic evidence. Verified DOA units will be repaired, replaced, or refunded at our discretion.

No Returns for Change of Mind

Because our products are custom-built, limited-run, and made to order, we do not accept returns or issue refunds for change of mind, buyer's remorse, or incompatibility with your specific motorcycle model — unless explicitly stated otherwise in the product listing.

Compatibility

It is your responsibility to verify that the product is compatible with your motorcycle model, ECU variant, and electrical system before purchasing. Helmet.Theory provides compatibility information as general guidance only. We are not liable for incompatibility issues.

Shipping Damage

Inspect your package immediately upon delivery. Any damage that appears to be shipping-related must be reported within 48 hours of delivery with photographic evidence of both the packaging and the product. Claims made after this window may not be accepted.

When you join a waitlist, place an order, or submit a contact form, we collect the minimum information necessary: your name, email address, phone number (if provided), shipping address, and order details. We do not sell, rent, or trade your personal information to any third party.

Your data is used solely to process your order, communicate order status updates, and send relevant product announcements. You may opt out of marketing communications at any time by replying to any email with "unsubscribe".

Ownership

All product designs, CAD models, PCB schematics, firmware, software, brand assets, logos, photography, written content, and engineering documentation published on this website are the sole intellectual property of Helmet.Theory (Akash) and are protected under applicable Indian and international intellectual property laws.

No Reproduction

You may not reproduce, copy, reverse-engineer, clone, redistribute, or create derivative works based on any Helmet.Theory product design, firmware, or creative asset — in whole or in part — without explicit prior written consent from Helmet.Theory.

Open Source Components

Certain components of our firmware or software may incorporate open-source libraries. Their respective licences remain in effect and are available on request. The proprietary layers built on top of such open-source components remain exclusively owned by Helmet.Theory.

Trademark

"Helmet.Theory", "Butter", "Heaty", the Helmet.Theory logo, and associated marks are trademarks of Helmet.Theory. Unauthorised use of these marks in any commercial context is strictly prohibited.

WARRANTY

Limited Warranty

Coverage

Helmet.Theory products carry a limited warranty covering manufacturing defects in materials and workmanship for a period of 90 days from the date of delivery. This warranty is non-transferable and applies only to the original purchaser.

Exclusions

This warranty does not cover: (a) damage caused by accident, misuse, abuse, flood, fire, earthquake, or external causes; (b) damage caused by operating the product outside permitted or intended uses; (c) damage caused by service performed by anyone who is not a representative of Helmet.Theory; (d) cosmetic damage including scratches, dents, and broken connectors; (e) damage caused by modifications not authorised by Helmet.Theory.

Remedy

Our sole obligation under this limited warranty and your exclusive remedy shall be, at Helmet.Theory's option, to repair or replace the defective unit. Helmet.Theory is not liable for any incidental or consequential damages related to warranty claims.

EXCEPT FOR THE LIMITED WARRANTY DESCRIBED ABOVE, TO THE MAXIMUM EXTENT PERMITTED BY LAW, HELMET.THEORY EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
